          TERRI T. MOSLEMS COMPLAINT IN INTERVENTION

         COMES NOW Terri T. Mosley, Plaintiff-Intervenor, and for her Complaint in Intervention against Defendant Dolgencorp, LLC, d/b/a Dollar General, shows the Court as follows:

         NATURE OF ACTION

         1.

         This is an action brought by the Equal Employment Opportunity Commission ("EEOC") under Title I of the Americans with Disabilities Act, as amended ("ADA") and Title I of the Civil Rights Act of 1991, to correct unlawful employment practices on the basis of disability and to provide appropriate relief to Plaintiff-Intervenor Terri T. Mosley ("Mosley"), who was adversely affected by such practices.

         2.

         Plaintiff-Intervenor Mosley seeks to redress the discrimination against her in violation of the ADA including based on being regarded as having a disability and Defendants denial of employment to Mosley because of her disability.

         JURISDICTION AND VENUE

         3.

         The bases for jurisdiction are set forth in the Complaint filed by the EEOC in this action ("Complaint"), ¶1.

         4.

         Venue is proper in this Court pursuant to 28 U.S.C. § 1391 and 42 U.S.C. § 2000e-5(f)(3). The unlawful employment practices alleged below were committed in the Southern District of the State of Georgia, and the Defendant has substantial contacts with this judicial district.

         PARTIES

         5.

         Plaintiff-Intervenor is an African American female who was seeking employment as a sales associate from the Defendant.

         6.

         Plaintiff EEOC is identified in Complaint ¶ 3.

         7.

         Defendant Dolgencorp, LLC d/b/a Dollar General is identified in Complaint ¶¶ 4 and 5.

         CONDITIONS PRECEDENT

         8.

         All conditions precedent to the institution of this action have been fulfilled by Plaintiff EEOC and Plaintiff-Intervenor Mosley as set forth in Complaint ...
