After an independent review of the record, the Court concurs with the Magistrate Judge's Report and Recommendation, to which no objections have been filed. Accordingly, the Report and Recommendation of the Magistrate Judge is adopted as the opinion of the Court.

Defendants' Motion for Summary Judgment as to Plaintiffs access to the courts claim is GRANTED, and the corresponding portion of Plaintiff's Complaint is DISMISSED. Defendant's Motion for Summary Judgment, as converted into a Motion to Dismiss, regarding Plaintiff's First Amendment claims is GRANTED, and the corresponding portion of Plaintiff's Complaint is DISMISSED, without prejudice, for failure to exhaust his administrative remedies. The Clerk of Court is hereby authorized and directed to enter an appropriate Judgment.
